They should say only open weight models that provide all training data, instructions, and anything else required to reproduce the model are allowed to be used in the US. Otherwise, it's just a black box trap or maybe not, you'll never know. Besides, the hardware required to train is the actual moat so what's the problem of providing the actual source?
