Swoopo is a scam - a scam which is relying on the law taking long enough to catch up that they can make a killing in the meantime. If you want to give fans a chance regardless of their wealth, run a suitably licensed lottery limited to one chance per person. If you want to give bands more money, sell more tickets. If you just want stupid people to give you their money for no good reason, then sure, Swoopo's a powerful model. Morally repugnant, but very powerful.
