Unity had the same in its license. But they changed it without notifying and when you updated the engine the new license applies even if it's a minor version so Unreal can do the same thing.

I always like to compare Silicon Valley to The Big Bang Theory. TBBT seems like a parody of the stereotype of the people they are parodying while SV is a true parody. I'm always thinking "haha, that's so true" when watching SV, but never while watching TBBT.
That would be extermely complicated and would require additional support from every game. Streaming right now takes every frame, compresses it and forwards it, as simple as that and works for everything.
The cost you are talking about is only for physics and logic in multiplayer games, it doesn't apply to single player games. And even then it is negligible compared to the biggest cost in gaming: rendering. Prediction requires rendering being done on the client, which requires a hefty video card and defeating the purpose of streaming.
I don't know compared to Unreal but Unity has several hidden performance issues. I am currently working on Bullet Boy [1] and we had several obscure problems that you have to fix with a lot of trial and error. Specific combinations of components and attributes can cause frame rate to drop because of the internal organization of the engine (moving colliders without rigidbodies comes to mind).
That being said, it is really easy to use. The asset pipeline is great and artists learn to use it very fast. It works really well for small teams.
My recommendation is that you should consider it if you are not planning to make a very performance intensive game.
